Training

Check out our recent blog: Competence is more important than attendance & Learning vs Training. We can be very focused on “is the training up to date”, “are they in date” or “who is due”. This is a legacy of CQC's predecessor CSCI because their version of inspection was very focused on “have people completed the required training?”
It was written into the legislation. However, what actually happened were high profile investigations such as Panorama that changed legislation. It works like this:
The former legislation states everyone must complete this list of training courses, everyone must be “in date”! So the RM dutifully makes sure everyone is in date, they have been on the course and they have got their certificates; in fact they have a whole folder stuffed full of certificates. The RM is meeting the legislation, box ticked!
BUT…
Then an inspector turns up, looks at the folder full of certificates and can see that everyone is in fact “in date”. The RM has done a great job of meeting the legislation, but, whilst the inspector is there, they witness poor practice… (think Panorama).
Hang on, everyone is in date, the RM is meeting the legislative requirements, but the inspector has seen something which need addressing and they cannot do anything about it because the RM has met the legal requirements.
This is why the legislation changed in 2015, the Care Certificate started and the principle of Competence was embedded into the Legislation: Health and Social Care Act 2008 (Regulated Activities) 2014 Regulations. CQC Regulation 18
